TERMS AND CONDITIONS
Commercial Use License
A photograph is considered intellectual property and is automatically copyrighted to the photographer as soon as it created.
What you can do:
Upon full payment of services, Chicago Commercial Photography grants you a perpetual, non-exclusive, non-transferable, worldwide license to use the
images created for you for permitted commercial purposes, defined as:
- advertising, promotion, brochures, packaging
- as part of a commercial website for promotional purposes use
- prints, posters, flyers, tearsheets for promotional purposes (not for resale)
- prints, posters, or other commercial display of image
- magazines, books, newspapers, other printed publications
- video, broadcast, theatrical
What you may not do:
Buyer may not resell, relicense, redistribute without express written permission from
Chicago Commercial Photography (photographer). Use as a derivative work, and reselling or redistributing such derivative work is prohibited. Images may not be used in a pornographic, obscene, illegal, immoral, libelous or defamatory manner. Images may not be incorporated into trademarks, logos, or service marks. Image may not be made available for download.
Chicago Commercial Photography (photographer) retains all rights, license, copyright, title and ownership of the image(s).
We reserve the right to use any photo captured by Chicago Commercial
Photography as samples of our works unless otherwise agreed upon in advance. There is no warranty, express or implied, with the purchase of any digital image file. Neither photographer nor Chicago Commercial Photography will be liable for any claims, or incidental, consequential or other damages arising out of this license or buyer's use of the image(s).
Cancellation Policy:
At Chicago Commercial Photography, we understand that
unforeseen circumstances can arise, and sometimes
cancellations are unavoidable. This policy outlines the
terms and conditions for canceling a confirmed photography
booking with us.
Confirmation of Booking and
Agreement: A booking is considered confirmed and
an agreement is established once the client receives and
acknowledges a written confirmation from Chicago Commercial
Photography, typically via email, outlining the agreed-upon
project details, scope of work, fees, and scheduled date(s).
This email confirmation, or a completed submission form from
our website detailing the agreed-upon terms, serves as the
binding agreement between the client and Chicago Commercial
Photography.
Cancellation by Client:
All cancellations must be submitted in writing (via email)
to Chicago Commercial Photography. The cancellation will be
effective on the date the written notification is received
by us.
Cancellations 30 Days or More Before
Photoshoot Date: If a client cancels a
confirmed photoshoot booking 30 days or more prior to the
scheduled photoshoot date, a cancellation fee equivalent to
10% of the total agreed-upon project fee will be charged.
Any payments made beyond this 10% fee will be refunded to
the client.
Cancellations Within 15-29 Days
of Photoshoot Date: If a client cancels a
confirmed photoshoot booking within 15 to 29 days of the
scheduled photoshoot date, a cancellation fee equivalent to
50% of the total agreed-upon project fee will be charged.
Any payments made beyond this 50% fee will be refunded to
the client.
Cancellations Within 14 Days of
Photoshoot Date: If a client cancels a confirmed
photoshoot booking within 14 days of the scheduled
photoshoot date, the full agreed-upon project fee (100%) is
due and non-refundable.
On-Site Cancellation
or Shoot Inability (Client Responsibility): It
is the client's responsibility to ensure that the chosen
location is suitable, safe, accessible, and adequately
prepared for the photoshoot, including sufficient space for
equipment setup and operation, and that all necessary
personnel or products are ready.
If the client
cancels the photoshoot upon Chicago Commercial Photography's
arrival at the location, or if the photoshoot cannot proceed
or is significantly delayed due to reasons attributable to
the client (e.g., inadequate space, lack of access,
unreadiness of product/personnel, failure to secure
necessary permits or permissions, unforeseen client-side
issues at the location), the full agreed-upon project fee
(100%) will be due and payable immediately. This covers the
significant time, labor, and resources invested in preparing
for and traveling to your shoot.
Rescheduling
Policy: We understand that rescheduling may
sometimes be necessary. Requests for rescheduling will be
reviewed on a case-by-case basis and are subject to our
availability. Rescheduling within 14 days of the original
photoshoot date may be treated as a cancellation and
re-booking, subject to the above cancellation fees.
Force Majeure: In the event that Chicago
Commercial Photography is unable to perform services due to
circumstances beyond our control (e.g., natural disasters,
acts of God, severe illness, government mandates, widespread
equipment failure, or other unforeseen major events), we
will make every effort to reschedule the photoshoot at a
mutually agreeable time. If rescheduling is not possible, a
full refund of any payments made will be issued, excluding
any non-refundable expenses already incurred that cannot be
recovered (e.g., non-refundable specialized rentals,
unrecoverable travel costs directly related to the cancelled
date).
Payment of Cancellation Fees:
Any applicable cancellation fees will be deducted from
payments already received. If payments received do not cover
the cancellation fee, the client will be invoiced for the
outstanding balance, payable within 15 days of the
cancellation notification.
We understand that a
last-minute cancellation can be frustrating, and you might
wonder why the full amount is still due when the photoshoot
didn't take place. For commercial photography, our pricing
reflects more than just the time spent actively shooting; it
encompasses the significant investment we make in preparing
for your project, even before we arrive on-site.
Here's why our policy is structured this way:
Dedicated Time and Lost Opportunity: When we confirm your
shoot, we block out that specific date and time exclusively
for your project. This means we turn away other potential
work that could have generated revenue, as our time is our
primary inventory. A last-minute cancellation results in a
complete loss of that potential income for the day.
Extensive Pre-Production and Planning:
Before the shoot, we invest considerable time in
understanding your needs, planning the shoot logistics,
selecting and preparing the right equipment, coordinating
any necessary crew or assistants, setting up the website to
display your photos, and sometimes even scouting locations
or sourcing props. This essential groundwork is completed
regardless of whether the shoot proceeds.
Incurred Expenses: We often incur direct costs
specific to your project, such as travel time and expenses
to and from the location, parking fees, specialized
equipment rentals, or even payments to assistants who were
scheduled for your shoot. These are sunk costs that cannot
be recovered.
On-Site Investment:
If we've already traveled to your location and begun setting
up, we've committed significant labor and operational time.
This includes loading and unloading gear, assessing the
space, and starting the setup process.
Our
cancellation policy is designed to protect our business from
the substantial financial impact of lost work opportunities,
time invested, and expenses incurred due to last-minute
changes or unforeseen issues at the client's end. It allows
us to continue providing the high level of service and
dedication that our clients expect for every confirmed
booking.
